Can I make an OWCP Federal Workers’ Compensation claim for my mental health?

The answer is yes, but OWCP Federal Workers’ Compensation claims have a lot of moving parts. There’s basically three different types of emotional distress workers compensation claims. One arises from a prior injury that creates a mental health disorder which could be approved as a workers compensation claim. The second type of emotional distress claim is not a derivative of a prior injury but could be due to a certain exposure at work that creates a post-traumatic stress disorder or some sort of emotional distress problem as a result thereof. The third one, which is the hardest to prove, is that you’ve got an emotional distress disorder based upon harassment or discrimination at work. These are very complicated issues and it’s important to know the distinctions between each one.

Even though emotional distress claims are often harder, that does not mean you will not be approved. It is recommended to have legal representation to ensure your claim is a strong as possible.
